Single Will
A Single Will should only be used for someone who is either single, widowed or divorced. Under the Will you can nominate the people you wish to benefit from your estate. This can either be by specific gifts of items or money or alternatively from all their remaining assets pooled together (Residuary Estate.) You can also appoint the Executors who will see that the terms of the Will are carried out and act in your estate.
A single Will can also be used to appoint Guardians for children under 18.
Mirror Will
Similar to a single Will but for married couples Civil Partners or co habiting couples who wish to benefit their surviving partner and make provision for circumstances where the surviving partner may have passed away before them. Two Wills are executed covering both scenarios and the only difference is the name.
Property Protection Wills

Property protection Wills can be drawn up which primarily are the same as a normal Will but specifically leaves each persons interest in the family home or alternative property either to children or a 3rd party instead of across to the surviving partner. This part of the property is then protected from care home fee costs should the survivor require care.

Discretionary Will Trusts

By including a Discretionary Trust in your Will you allow flexibility as to who will benefit. Your nominated Trustees operate the trust and you specify who can potentially benefit from it, for example your partner and children. The Trustees can then look at the individual circumstances at the time and provide for the individuals accordingly.
The great news is, like a Property Protection trust, any property included in the Trust would not be considered for Care Home fees. They are a great long term planning tool whilst retaining some flexibility. They can also have Inheritance Tax benefits too.
